Quick question!

If the NCP has and is ordered to put children on Insurance and does so for 1year+ and CP refuses to use (never has), can NCP ask that CP reimburse them for having to pay when it has not been utilized?

NCPs are required to carry insurance for the child. There is no law that states the CP has to use it, nor reimburse the NCP for the associated premiums. My childs othe parent has medical, but mine is primary so I use it first, and if there is extra needed to be covered, his NCP is secondary.

Legally what can be done? The AG says they didnt think that was an option and I know a judge can't make anyone pay anything really but they can find other ways..She did say however that NCP can stop paying it with an order and to fill out the form they have online to get that done!


Im curious though why would they would make one parent pay for something and not force the other to use it? Does this not happen often...I havent seen too many cases but then again im more familier with custody than support.

My dumb-dumb X DOES have insurance coverage for SweetPea. Do you think he would actually SEND an insurance card? I've asked enough times. When I'm up there for the motion, I'll be having my hand out for a card in front of the judge.

Doesn't he have to send the info to the Child Support Registry? CP tried saying the DR couldn't read the card!

I have had problems with my insurance card getting demagnetized. But guess what - the doctor's office then called the insurance company to get the needed info. In the mean time, I requested new cards.
 
Simple fix, fax insurance cards to doctor and let them know there is another insurance.

For Tink... I was able to talk to billing manager at children's doctor explain the situation (X refused to give me insurance cards), so billing manager contacted X's employment had them give them information of what company they used for their employess, then contacted that company and got the right information.

In court, I explained to Judge what billing manager had to do to get insurance information, X tried to say he did not even have his insurance card on him, so Judge told him to call his wife and have her fax it to court house and we would continue on the case once that was done. X tried to say he couldn't get the information and Judge said well I guess I cannot handle anything else on this case until you are able to, it was funny that within 30 minutes, Judge had a faxed copy of insurance cards in his hands, which he had clerk give to me. Judge then told X if he did not supply me with cards as they updated he would definately find him in contempt and would fine him.

The bolded is incorrect because NCPs are NOT required by law to carry it. If it is available A PARENT or BOTH PARENTS can be required to carry it by court order but that does NOT mean that it is the NCP.

If the CP is not using it and the NCP is also supposed to pay a portion of uncovered, they can take it to court instead of paying so that they only have to pay the portion that would not have been covered had the NCP's insurance been used.

Well, in my case, I am not required. At our hearing, the master told ex he was required to carry. I got my childs insurance since birth, cause my ex refused to help with anything until he was forced to, by law.

I only kept my insurance as a backup. If ex were to drop his insurance, his CS will go up, but thats based on marylands guideliens.

Of course, a CO can make parents do anything:)

Well Medicaid was notified twice! And the Dr office was called. The Pharmacy is having printouts of all rx's CP has picked up and it will show the ins used but none have been used on NCP insurance. For Court. We were able to view online.
