Your tenant is responsible for the action of his guest. In your case, I hope you were smart enough to get personal data on all occupants. In the event you don't have data on them, send them a bill and evict ALL if they refuse to pay. That includes the tenant on the lease. Never let anyone live in your property without your consent and without their personal information.

If they occupy the rental unit, they DO have a lease. Absent a signed lease, the state automatically creates a month-to-month lease to protect the now tenant and the LL.

You would simply pursue them just like you would any other tenant who caused damage to your property.
