Heres the story. Its long. My husband bought a truck at the end of November 08. It was used and never was checked by a mechanic as they had just recieved the truck. By the end of Jan 09 the transmission was slipping and would not shift. After a day of doing this it woud not drive over 30 mph. We called the dealership and they said to bring it in after we told them it needed to be fixed. We live a good 3 hours from dealer. My father rented a trailer and came to help pull the truck. 2 and a half weeks later we get the truck back after the truck went to two seperate transmission shops we were told it was being fixed here and there and when I did call the transmission shop they told me they never got a go ahead to work on it. The next day I called the same T shop and they told me it was picked up!!!! I called the main office they said it was taken to a client of thiers to be fixed. This was almost 1 week and half into them having the truck. I waited in a nearby town at my parents this entire time with my 4 month old, while my husband stayed to work where we lived. We finally got the truck.
Then in March it happened again. My husband took it straight to the shop where it was the last time as there was a warranty on the transmission. Another week.
After the 1st incident we bought a travel trailer for my husband as so he could work in that city and I could stay in our previous city where my sons dr, wic and his daughters are. With the problem due to the truck he could not pull the TT to the location and we stressed this to the dealership who kept saying they would fix it and give them another chance. My husband at one time said just come get it. They were going to with a tow truck and never did. As a result my husband continued driving the truck. 2 hours to work and 2 hours back every day going to back way because he stayed with slower traffic and he ended up in an accident two nights ago.
My question is if not for our problems with the dealership and not fixing the truck and if it did not have the tranny problem can they be held responsible for all we have dealt with???? The accident, the stress, not making my sons dr appointment.... I hope everything. I know we can file anything but what legally can he be entitled to?? Thnk you...
