Seperate mediations.

What is the name of your state (only U.S. law)? CA
I was taken by suprise when I went to mediation and was told the other parent wanted to be interviewed seperate because she was afraid of me. We have had heated discussions as everyone does, but I have not and would not ever use physical violence to her or any women. How is it that they can just take her word without any proof? Is the mediator able to figure out during the first mediation that I would not cause any harm as to allow both parties be seen together at the second mediation? Do they get the seperate mediation request alot?

Why does it matter if you were caucused during mediation? Seriously? Whether you hit her or not if she feels afraid then she feels afraid and she has a right to request to mediate from seperate rooms. And no one can figure out that you would not cause any harm. You seem to want to force the issue. Why is that?

This isn't a criminal case. They don't need her to prove anything.

The mediator isn't going to take the time to sit down with the two of you and figure out if you can make nice. She's entitled to separate mediation if she requests it. Deal with it.

DH chose not to be in the same room with his ex when they mediated issues at one point b/c she's, well, her. :p Whatever works.

IT seems to matter alot. If there is a mind set on the part of the mediator, how can a true mediation take place when the main topic is a made up version of domestic violence? I think its much harder for a person to make things up when both are in the room. Then the real issues of the best interest of the children can be discussed.

Thats what I am finding out. It just seems like there is a better way.

If you X feels that you will try to get your way and feel intimidated in getting what they want, sure - separate mediation is appropriate.

Intimidation does NOT mean being afraid of someone assaulting them PHYSICALLY. It can be emotionally assaulting them.
