letter from a 9 year ticket!!

What is the name of your state (only U.S. law)? Texas

Hello all. My husband recieved a letter in the mail from a Justice Court in regards to a Minor in Possession of A/B. It was dated 04/29/00!

They said that he plead no contest. She also said they suspended his DL and its not suspended at all. Is there a time limit on these things? Can he fight it?

Well what does HE say? Did he plead no contest or not? If he did plea then it sounds like he never paid the fine. There is no statute of limitations on that and no there isn't really anything that can be done to fight it. If he doesn't pay it, they will issue a warrant and once arrested his bond will be set at whatever amount he owes on the fine. So he either pays the fine at that point or sits out the equivalent amount of days in jail.

If he didn't plea then there is some mistake and the case should still be open. Statutes of limitations only apply to cases that have not been filed, so no SOL here, but there is a right to a speedy trial so if it is their mistake I would expect they'd just dismiss it. If not you can file a motion for dismissal based on violation of speedy trial.

I had a ticket in NV once for $100. i didnt pay it. 6 years later with no warrants mind you i get the letter. The fine with interest from the court collection agency was now $660. that was expensive speeding ticket.
