NCP in contempt.

so, court order issued is the 11 year old son and the 7 year old son is to go to tutoring.

no biggie. i take kids to library tutoring tuesdays and thursdays. didn't go on wednesdays and fridays since wednesdays was dad's day anyway and i wouldn't be taking him every friday.

NCP requested to change his wednesday overnights to tuesday overnights. i said i would agree if NCP would take sons to the library on tuesday to keep with the same schedule. NCP agreed in court. court ordered reflect dad to take children to library for tutoring on tuesdays. turns out, NCP has taken the kids ONCE. the first tuesday he was granted the change. and then never again after that. hearing was in March. so, i am now taking the kids wednesdays, thursdays and fridays (on my fridays) to make up dad's lack of interest in children's education.

now, we have another status hearing in august. i would to have dad's visitation moved from afterschool until 6 or 7 pm so i can take the kids myself and be sure they go. he still gets his overnights, and i still get to make sure the kids have their tutoring per court order.

aside from filing contempt, would this be an acceptable schedule in the children's best interest?

i wanted to throw this out there and see how it might be viewed. ;) at least before i get my head chopped off in court.:eek:

I dunno, Isabella - if Dad isn't upholding the agreement (assuming he doesn't have a good reason for doing so) and your proposal is designed to ensure that tutoring does take place (as opposed to it being a way to get at Dad) ..I don't see how you'd become Ann Boleyn's basket-mate, you know? :)

It does seem to be in the best interest of the kids. At least to me!

What's Dad's reason for not taking them?

it interferes with his parenting time. well, his words..."it takes up too much time"

in my crazy opinion, when your child has "d's" and "f's" on a report card, you should start MAKING the time. but then, i'm a little nutball.:eek:

yes! 4 days a week. both kids. 1 hour. monday, the library is closed otherwise i'd do 5 days a week.

File contempt and for a modification based on the fact that tutoring is something the court ORDERED dad to do with the children, it is in the children's best interests and dad has shown through his contempt that he refuses to do what is best for the children hence his time should not begin until the end of tutoring and he can pick the children up at the library after tutoring is over on his nights.
