I received a traffic violation for passing in between subway cars even though the train was not in motion and waiting inside of a station. The cop took me out the train but allowed three other people to pass through the train the same way i did. I am a young adult (18) and the other people were adults. The cop took down my information and the traffic violation was mailed to the wrong address. Regardless, the fine was increased by $25 because I missed the date to send in the money for ticket. This was no fault of mine and Im wondering can i go to a hearing and get a reduction to the violation or even get it thrown out? I did not know that passing between cars was a violation and people after me were performing the same act as i did. Can i say it was age discrimination as well?

Ignorance of the law is no excuse. Your claim of discrimination is bogus and unfounded ~ you just happened to be the lucky one.

Absolutely. 18 year olds are allow to plead innocent by reason of stupidity. You don't become a fuctional adult till you turn 19.

Given that the subway doors now have those cute little pictographs that show people walking through the doors with a big red line through them, it'll be hard to convince anyone with a modicum of higher brain function that you were not aware of the prohibition against using the door. Not that it matters, ignorance is not a defense.

You may be entitled to a waiver of the $25 late fee though if you can prove the violation was mailed to the wrong address AND that you didn't get the pink copy when you were originally cited.

I haven't been in NYC for many years. That law is news to me and a little strange, too, especially enforced as described above.

I would not rule out age discrimination. Cops probably do tend to focus on young people as potential troublemakers. However, that or selective enforcement could not be backed up (without access to security cameras, which is not going to happen). I don't think writing a note and including it with payment would do any good, but I doubt it would hurt. A tip to an NYC news outlet might be more productive. Possible widespread discrimination deserves investigation.

By all means, if the address it went to was never the right one and there was no physical ticket given on the train, the late fee ought to be contested.

My main reason for responding, though, is the thread's placement here. I understand that there might not be a specific place for it, but it definitely is not about parking tickets or anything about operating a vehicle.

It is a citation.... for a non moving violation... So this is as good a place for it as anywhere else.
