New car is a lemon ?

What is the name of your state (only U.S. law)? Georgia

I bought a Hyundai Veracruz (crossover) less than a year ago, and have it in the dealer service shop at least 3 times for the same issue. The rear hatch tends to open on its own sometimes, and sometimes when inside the garage. The first time I complained to the dealer, i was told they couldn't get it to duplicate the problem, so there was nothing wrong. The second time the paint was damaged when it happened in the garage, and again i was told that they could not duplicate it when they had it and would not repair the damage. After a battle with the manufacturer, they agreed to repair the damage. Now, 3 months later, it happens again, this time doing more damage and breaking the rear window. I now have the vehicle at the dealership waiting to see if the regional rep will fix it or not. Is this car a lemon and should I persue a lemon law claim?

Can the rear hatch be opened with a remote control? I know someone that had the same problem with a Lexus SUV, once or twice a month she would find the rear hatch open. After happening about a dozen times, a neighbor came over one day and wanted to show her something. She went outside and saw the rear hatch open again. Her neighbor closed the hatch then pulled out his garage door opener. He pointed at the Lexus, hit the button the POP, the rear hatch opened. She had the frequency for the remote changed and the problem hasn't happened since. Perhaps there is something in your neighborhood that operates on the same frequency that is causing the problem.

I guess that's a possability. It does have a remote control, but it also has power controls inside the vehicle. It even looks like a Lexus suv. But the dealer never mentioned it. It only happens occasionally, like every few weeks or like this last time 3 months later. At this point, my wife is afraid of this car and I don't know how to handle this. When i spoke to the general manager about this, he said that it could be a lemon law issue. What do you think?

Hyundai's are notorious on trunks and hatches for opening and it has to do with the release button on the fob. They only need depressed briefly (even in pants pocket) and they pop open. Most cars you need to double click them or hold them in for 3 or more seconds to release. My wife and son each have Hyundai's and they do that. At first I was yelling at them about leaving vehicles unsecured, lol.
