Sorry this is third party, if you need any more info, I can have my mom get on here. My mom has had my brother's son for almost a year. The mother and father both agree it's in his best interest right now to stay with her. What they want to know is what they need to do so that she can take him to the doctors, put him in daycare, etc. Would she just need to get a power of attorney? She doesn't want to file for custody.

she can file for temporary guardianship. those can be revoked at anytime.

check with the daycare's/school. some will take POA and some won't.

Isabella is somewhat correct. They should apply for guardianship. Not only can it be revoked by the parents BUT after one year it automatically expires. What county and I will try to find the proper forms.

New Problem

My mom has had my brothers son for a year now. His dad does not live around here and wants him to stay with my mom and his mom just got arrested in a big drug bust and is going to be in jail for a long time. My mom now wants to file for custody but doesn't know how. Would it be the same papers as if the other parent were petitioning for custody?

No. She would have to file in juvenile court and sue both parents for custody in a third party suit.
