I had millions on an affiliate account, and now it's gone. I have proofs that the money was there. I contacted them and they said it was a miscalculation.
I live in europe, and the company where I'm an affiliate is located in Sillicon valley.But the problem is that the money stayed there for more than 2 weeks. I could have bought a lot in the mean time. In my mind I was a millionaire already. And when it was gone, I became depressed :(
Can I sew them ?
Is there a lawyer in here who can help me with this?

If they made a miscalculation, the money was not rightfully yours, so you have no claim for the millions they inadvertently said were yours.

The closest tort you have a claim for is emotional distress caused by negligence. This is most often used when witnessing the death of a family member. It has been held that witnessing the death of a friend does not rise to the level of emotional distress caused by negligence.

In order to win a judgment, you would have to PROVE:

The emotional distress is severe
The emotional distress was legally caused by the negligent action and
The emotional distress was reasonably forseeable by the defendant.

Short answer, you don't have a case.
