How to enforce a parenting agreement?

What is the name of your state (only U.S. law)? Vermont

My brother has a parenting agreement with his ex girlfriend for the last 6 years it has worked perfectly for them. My brother had his girlfriend move in and now a year later his ex has decided to file for a TRO which was denied by the judge saying he hit their oldest son. She also said they do not have a Parental rights and responsibilities agreement (but they have a parenting plan.) A clerk wrote on paper work that there is no plan in place so the unwed mother according to article 14 V.S.A. 2466 (Vermont) has guardianship until a Parental rights and responsibilities has been issued. So my question is how do you enforce a Parenting Plan when she has decided to not let my brother see or talk to his boys' until their court date in August. The clerk told my brother the judge is out of state on vacation so she will not see any paperwork until she gets back. Shouldn't another judge step in under these types of circumstances to enforce and order or are we expecting too much? They have 50/50 arrangement and by the time my brother sees his boys again he is going to miss 6 weeks with them.What is the name of your state (only U.S. law)?

Then he should file contempt AND ask for makeup time. Or a change in custody.
