Coverage for Travel Trailer W/ Twist

What is the name of your state (only U.S. law)? MO

A man bus a Jayco Travel Trailer and titles the trailer with his name and the name of his female friend. (John Smith and Betty Boop) He keeps it at his house (primary residence). He gets married, but never changes the ownership or registration on the trailer. He died last year, so the the ownership of the trailer would go to the other person. I know this is convoluted, but...

If the trailer is stolen, how does (or is she entitled to) get the payment from the insurance company for the stolen trailer. The wife had no interest, it was not marital property. I want to call the agent, but I need to know if I am even close to rational.

First, I think his wife would retain his ownership in the property because it's part of his estate. Secondly, You would call your insurance company and report it stolen, provided it was insured.

Thanks. The trailer was owned by the man and a woman before and during his marriage. The wife never owned part of the trailer. The other woman stayed on the title along with the man, thus it was not part of the probate estate. The wife also held real estae outside of the marriage and probate estate.

Again, the owner would not necessarily pass directly to the other person on the title outside of probate.

The wife should get the husbands half when he dies. Unless a will states otherwise, his belongings become hers, including everything he owned before getting married. As far as the insurance, did they have insurance on the trailer? If so, she should be able to call the insurance company and file a claim.

Aftre A couple of years, A marries C, but does not change the ownership on the trailer to include his wife, nor does B relinquish her claim to the trailer, but A dies. I thought in Missouri, when two people jointly own something, title and ownership pass to the other owner. Maybe, I have been watching too much Judge Judy or Judge Joe brown, but oh well!

OK, let's just say for the sake of argument you're right. I believe your question was how to claim the theft of the trailer on the insurance. The first question is: Was the trailer insured? The second question is: Are you listed as an owner on the insurance?

I believe that American Family has at least $1,000 coverage on the trailer (as a part of a deluxe homeowners policy), if it the loss occurred at same location as the insured house. I don't know if there were any riders or additional policies and don't want to know until I determine if B can receive the payment.

I am not the insured, nor do I have any financial interest in this at all. I think A was actually the insurance

As far as insurance, I have not yet contacted the American Family Agent with my question, because I did not know the answer about coverage and beneficiary. If it would go to C, I would not even make an effort. If however, it was covered, I would love to see B (a 78 y/o Grnadmother raising one of her grandchildren due to child's mother's death. And by the way B's granddaughter has some special needs). So I am sure you can see it would be nice for B to get a break.

No, I a have no real dog in the fight, so the money means absolutely nothing to me.

The agent likely does not know the answer to the question. That's why you were directed to file a claim - with the CLAIMS side of the business. This is their job. This is what they do.

Thanks. I took your advice and talked to the agent this morning. And she told me she did not have a clue. but since she writes my home, cars, motorcycles, trucks, my father's cars and house, my sisters' houses and some of thier cars, my older son's house**************. she thought she would be delighted to just do some reaearch with her claims people and get a better determination. She also told me (very politely) that this situation was none of my business, but, if A's son (the executor) were able to formally inquire, she would probably be able to answer most of the questions**************..

So now I understand. You own the trailer, but it was stored at the deceased's home where it was stolen. You want to find out if you can file a "homeowners" claim with the deceased's insurance company since you had no insurance on the trailer.

I think they are the ones who are going to have to file. Your beef would be with them. If they don't file a claim and pay you the money, you will have to sue them. Then they will contact their insurance company to represent them. If they are responsible, and their HO insurance policy covers the theft, the company will pay.
