ebay and PAYPAL RIPPED SELLER. WANT TO SUE THEM HOW?

I NEED ADVICE ON WHAT I CAN DO WITH THIS CASE TO GET MY BAG OR MONEY BACK.

Short version: I sold an authentic louis vuitton bag on ebay with receipt and ok'd to have buyer send the bag back to get the refund. Paypal told him to send to my old address that they have in file. I tried to tell my buyer to send to the confirmed address that is also on file. He wont. My buyer ended up sent to the old address anyway but usps said "undeliverable as addressed and return to sender." I told my buyer and called paypal about the situation that the bag mailed to the old address and postal office sent it back to sender (my buyer). Paypal said they called and emailed him to have him resend the item to the corrected address and My buyer never send the bag back. I called paypal today to complained they went ahead and refund my buyer $499 w/o sending the bag back. I told them I have tried to call, text and left messages for my buyer for new confirmation of resending the bag. They didn't listen and fully acknowledge that tracking said the item was undelivered and usps sent back to sender. I told paypal dont refund the fee, yet, wait until I get the bag. They didnt' listen. They said, "our record shows he sent eventhough the item was undelivered and returned to him" and it is our policy that it is proof he sent and that is all we care so you have to contact your buyer directly OUTSIDE OF PAYPAL TO GET THE BAG BACK. AT THIS TIME, WE CAN'T DO ANYTHING FOR YOU." THEY COUDLN'T WAIT TO SHUT ME UP AND GET ME OFF THE PHONE. What can of bs is this? They gave me no protection and I am very familiar with their dispute form that I have to go in and select "I have received the returned item" . I didnt select because I'm still awaiting for him to send the bag but paypal took the matter on their own hand and acknowledge that the buyer hasn't send the bag back or have proof or signature that I received the bag either.

Bottom line my paypal ripped me off stole my money and gave to someone else from a legitimate seller with proof of sent item to buyer, usps confirmation that item my buyer sent back to me was undelivered and returned back to him.

Long version:
I sold a bag on Ebay in 7/2009 to a pointclickbuy501 customer for $499. I described everything and includes all the photo. I bought this bag for $500 on ebay so I included the previous sale info so buyer could have more information on the item. He is not happy and asked for credit. I told him I bought the bag from another person and I am not happy with it that's why I sold it back to ebay area but if I can get the credit from the other seller I would give him the credit. Long story short, I ok'd for him to dispute through paypal to get the credit. Paypal granted the decision in his favor which I wanted it and sent him the instruction to send the bag back to me by the 10th day and need to have "signature confirmation" due to the amount is more than $250 value. However, I was communicating back and forth with my buyer to have him send to another address and found out paypal told him to send to my old address that some how still in file. As soon as I discovered that I updated paypal immediately on the situation. It took my buyer several days to provide with tracking information and off course it would be too late. I callled postal to find out how to intercept the item and of course they put it back to the truck and on its way back my buyer. After several conservation with concern about this transaction paypal went ahead and refund the buyer his payment while I havent received the bag. Obviously my buyer didnt have any intention to send the bag back b/c he ignored my calls, text and messages. He accidentally called me and hang up as soon as he found out that was me.

I filed a complaint with BBB in silicone area and will file with MN Attorney General. My attorney friend couldn't make sense on how paypal can do that. I am trying to find out if I can file a lawsuit. If I have to fly to California I would just to make the point and of course I would report this to the Media on how sucks paypal and ebay is.


DONT USE PAYPAL OR EBAY. THEY ARE SUCKS AND THIS IS THE 3RD TIME I GOT RIPPED OF FROM THEM FOR BEING BOTH BUYER AND SELLER. I WISH THERE IS ANOTHER PLACE WHERE I CAN DO BUSINESS WITH INSTEAD OF PAYPAL.
