Change of Venue length of time poll

Accident - Bankruptcy - Criminal Law / DUI - Business - Consumer - Employment - Family - Immigration - Real Estate - Tax - Traffic - Wills   Please click a topic or scroll down for more.

What is the name of your state (only U.S. law)GEORGIA / COLORADO

If you changed venue from one state to another, how long did it take?
a) less than 30 days
b) 31 - 60 days
c) 61 - 90 days
d) 91 - 120 days
e) more than 120 days

The timing thing is important because I've budgeted my pay/savings draw down based on Colorado CS decree. If it's moved to GA, I'm sure it will go up.
So with 34 child support payments left, each month the calculus changes.

I was divorced in Colorado. I am the NCP. Things were peaceful, but CP decided that she needs more cash. The original CS order has not been changed since we divorced. It seemed to be adequate. Never mind that she makes 75K-80K per year to my $17K per year.
-CP and NCP both moved to Cobb County Georgia. Both of us have lived here for 11 years. Child is 15 years old.
-CP is making noises about Child Support Modification.
-I am not in arrears.
-CP earns 4-times my income
-I'm currently unemployed. What is the name of your state (only U.S. law)?

If you both live in GA and have for 11 years, any modification is going to be based on GA guidelines...that's a no brainer and its not going to take any time at all.

Also, FYI, CS in GA goes to at least graduation from high school...and can go to age 20 as long as the child is still in high school. Therefore unless your child is going to turn 18 AFTER she graduates from high school, you probably have more than 34 months to go.

IF it's converted to a GA order.

Child turns 18 AFTER graduation.

The point I'm getting at is how fast will the courts move my in-force child support order from Colorado to the laws of Georgia.

My guess is that it will take no time at all...I suspect that GA will simply "take" jurisdiction.

Its going to be...they have both lived in GA for 11 years. No way is CO going to retain jurisdiction.
I was thinking more along the lines of IF mom actually files for that Mod. She's "making noises"... it's a LONG way from "noise" to "action" a lot of the time.

In any case, Dad should go here: Georgia Child Support Commission

and run the numbers. If there's been no modification and mom makes so much more than Dad (especially if child care was included in the original calculations) it might not be as bad as Dad thinks.

Valid point...
