Hello All,

The other day my husband called me from a co-workers cell and asked I talk to him because he had questions about his divorce. Now Im more familier with Texas law than FL but this is what he told me. His wife is non-working and moved out of the home. He is living in the home he built on thier 7 acres. He said his son is 2 1/2 and he gets him every weekend. His question to me was what do i have my lawyer ask her lawyer? I told him if he had a good lawyer they should know. I asked him what he felt she would contest him on. Right now he is giving her 1000.00 and paying her car ins and has medical ins on the family. I told him if he is going to give her any money make sure there is proof. He said his lawyer told him he didnt have to give her anything. I said yes but that shows you care about your son being taken care of and I told him that he shouldn't give her more than one weekley check which is 900 as he said he was going broke already.

He said he really wanted his 4 wheeler.Can he ask for his 4 wheeler? What all assests are divided and what have to be sold if any? Now I did some research and found out that CS guidelines in FL go by both parents income. Now it says after taking both incomes they come up with a minimun amount to be paid. So if he makes 900 a week and she makes 0 will they make him pay the minimum amount for an estimated 3600 monthly income. It said about 700 something.
Also they were married 7 years. Is FL an alimony state? I found out there are three types of alimony here.
Next I read that the paretning plan will be a plan both parents agree on. FL as I read does not have an SPO type order in effect. So if he already gets his son every weekend can he continue that with a weekley dinner schedule?

Please give me some feedback. I want to get back with him as he is very, very confused which is normal. I wanted to recheck my research so im dont give him wrong answers....THANK YOU..

he was supposed to call me back but he hasnt yet. He works alot of hours during the week. At least 10 on a powerplant. I try to refer this website but I dont know any situations whether he can or not. My husband works with him.
