come on people- they got their order in Feb of this year......she had her opportunity to challenge him on this issue- she needs current proof
she is stating false accusations on me, the last time i had my daughter was in April, she was upset because she didn't want me to go to my brother son's 1st b-day party because she doesn't get along with his girlfriend anymore, she was so upset and hasn't let me have her, so every wkd i would have to get my daughter i would call her and she wouldn't answer so i made police rpts, one of the wkds it was mother's day, when the officer called her,her response was "it's mother's day i don't feel like driving up there" so she didn't even bring up the fact that she was accusing me....So what do you think I should do, get statement of relatives and friends of how i am with my daughter when she is in my care?

did you pass all test, until when did you guys have to both take the test, after how many tests?
I passed every test, but I was not accused of being on drugs, I accused her, I did not have any proof at all, I just said it in a hearing. The judge made us both go.

Each test was 145.00 every 90 days for 1 year. After 4 tests that were negative my atty asked the court that I be relieved of the drug testing. Hers were all positive for drugs, she was ordered to continuing taking the test, plus he added a urine test to her hair follicle tests.

personally, i'd take the freaking test. just to make the other party look like an idiot. but then i have an attitude problem.:eek: and i'd request that if i pass every single test, the other party has to reimburse me for the costs just for wasting the courts time.

I agree with Is... just go take the test.... most labs will give you a hair follicle test with either a court order, or a doctors order. Have the results sent to your doctor and your lawyer so they do not question the validity... and that should be the end of it.
 
I'll take it but i think if i can't take a periodically urine test, i can do that.
They can only ask you to take a hair follicle test, they can order you to take a urine test. Unless you are absolutelly sure what you have taken in the last 6 months, I wouldnt take the follicle test. If you have happened to take a medication you dont have a script for, (it will show up on the follicle test) you are sunk.

The court absolutely can order a follicle test. Just not in CA.

(I don't want anyone to feel that courts are unable to order follicle testing)

yeah, that's what i had been reading all over the place today. court ordered follicle testing.

False. You can be ordered to take a hair follicle test. In fact, Judges would rather it be a HFT.

And if you are taking drugs you don't have a script for, then you are taking drugs....

HFT do not cover all drugs. That is why the Judge ordered my ex to do a HFT AND a urine test.

Sorry I disagree, I was asked to take a hair follicle test, I refused and then ordered to take a urine test. Judge told the other party she could not order that I take a follicle test, only a urine.

My case is in CA.

Maybe you saw a Master, or there were other circumstances that the Judge would not order one, but I don't know a state that has a rule saying that a judge can't order a HFT.

PLUS.. if HER atty filed a motion requesting a HFT, then I would think the atty would KNOW the local rules and be aware that his county does in fact order HFT. If I were worrying about as much as the OP obviously is, I would just go get it over with.

To refuse the test is stupid if you don't have anything to worry about anyway.

I'm still waiting to hear if OP actually went to pick the kid up. If he didn't show up at the p/u location.... he's SOL.

so after she showed as positive, im going to request personally when i see the judge(if i get a chance) for her to take one as well, cuz she is a really angry person and has split personalities...but once her test came out positive did her visitations get reduce and did she get supervised visitations???

what court did you go too? where you located at?

I have to admit that getting the police involved on Mother's Day weekend was more than a little bit over the top dad...I hope you didn't include that one in your case, because odds are that it wasn't actually your weekend. Almost all standard guidelines/court orders address Mother's Day/Father's Day.
