What is the name of your state (only U.S. law)? CA
Dad is already trying to dictate who, what, when, why and where I spend child support.
Can somebody please direct me to California law regarding this issue.
To me it's a no brainer that I spend the money on the kids...
but hypothetically I can spend it on a night out to diner right/wrong?

Telling him to "go suck rocks" would be terribly uncivilized.....as much as I'd like to.;) I am aware that he is not to dictate where the money goes but
I would prefer a Family Code # or something similar.
Thanks for the idea though.

You won't find anything in the code cuz there aren't any rules on WHERE, WHEN, HOW, etc you spend the child support $$.

If you keep a roof over their heads, food in their bellies and clothing on their backs, you are fine.

If he wants an accounting on the above he should have stayed married to you.

Personally, just ignore the request. If persistent, tell him that HE has to find the code where you must provide the information.

That shows me you were wondering if he could dictate in some fashion. He can not and you shouldnt feel bad if you do. Do you tell him how to spend his money?

Personally, I had great fun getting a manicure and pedicure when monies from arrearage magically showed up in my checking account. :D:D:D Oh, did take DD also.

Really, he cannot dictate nothing, zip, nada, zippo.

Support monies collected are expected to be used for the child's expenses, including food, shelter, clothing and educational needs. They are not meant to function as "spending money" for the child.[25] Courts have held that it is acceptable for child support payments to be used to indirectly benefit the custodial parent. For example, child support monies may be used to heat the child's residence, even if this means that other people also benefit from living in a heated home.
not to support your hobbies habits or to buy shoes.

I'm not sure where he acquired this information.
I just thought that I could quote something legal if there was something available.

Yes, first check in 6 years. Rich indeed!
I won't mention to dad that during his next visitation with the kids....BF (who's been supporting kids along with me for 6 years) and I are going out to diner. And who's to say if that money is coming from me or support really? it all goes into the same account to support the household in the end anyway.
I won't feel guilty one bit.

Listen some states not sure if California is one does make it so that if if parent feels child support is being blatantly abused that person paying child support can ask for documentation proving how child support is being used. It would have to be an extreme situation and is very hard to prove because how is that parent going to prove that monies were child support and not the receivers own income. Look at it this way the child support payment payed a portion of your bills such as rent/electricity/food/ clothes/insurance that was used for the child/ren. Now how is the father going to know what of the child support was spent on those neccisities and what of your money was spent. With dad owing 70k and not paying in 6 years even if California was one of those states he wouldnt have a shot in hades. Ignore dad enjoy your dinner and if he asks how its spent tell him the same way youve been spending your money all these years without child support. To take care of your child.
