What is the name of your state (only U.S. law)? MN

In 2006, we filed a hail claim with our insurance company and received a new roof due to a hail storm severely damaging our shingles. The damage occured in 2006. Now, this month (Sep 2009), we were having performance issues with our central air unit and a contractor indicated it has severe hair damage--we assume from the 2006 storm as we have had no significant hail storms since then. Also, we have switched insurance companies so the company that the company that paid our claim is no longer insuring our house. Do I have any grounds to call the old insurance company and say that their adjuster back in 2006 did not find the hail damage that they should have seen and try to get some money from them? Or is the claim considered closed and therefore, we have no hope?

I am going to go with no, you cannot claim 2006 hail damge to your air conditioner in 2009. First of all you havent had a problem up to this point, so how could it be 2006 damage?

Second of all, do you want to be dropped? excessive claims (especially ones you don't report for 3 years) is a negative in the insurance rule book.


I mean you can try if you want to but I'm sure they will not hesitate tossing you a denial letter.

There may be old hail damage on the unit, and it may now be malfunctioning, but that doesn't necessarily mean the two things are related. If the damage was going to cause it to stop working, it would have done so right after it happened. It is highly unlikely your old insurance company will relate this to your prior claim even if it WASN'T way past a reasonable time to file the claim.
