Home Owners Write Off's

Hi I know that most employers tell you that when you write off a food or product it has to be thrown away and not kept or eaten under any circumstance. Well i work for this Restoration Company and when they write off the Home Owners (Furniture, cloths, electronics, jewelery, foods and misc.) Are they supposed to throw these objects away after the insurance company has give the Restoration Company the approval that the claim has been finalized or Are they allowed to keep these Home Owners Write Off's for the Restoration Company to (sell, keep or give) them away between each other(s) ? All i know is that when i write something off i know I'm not allowed to keep, eat, sell or give it away and it must be thrown away no questions asked. Is what this Restoration doing legal ? or Illegal please explain how it could be Illegal if it is.

Once the insurance company settles the homeowner claim, the insurance company takes ownership of the damaged property. They can then dispose of as they wish.

Hm yeah makes sense if it worked that way, So then why does the Fire and Flood Restoration company i work for take the damaged items back to the Fire and Flood Restoration company's warehouse and sell the homeowners items to there employee's after the homeowners claim has been settled/finalized ? The Insurance company has not once came to our Company and asked for the homeowners damaged items back. Instead the items are either sold amongst us or given to us as gifts. What would you call this operation that we do ? is this legal or Illegal ? Oh yeah and we have never thrown away any of the damaged items from the homeowners houses, they have just been sold or given away as gifts.

Ask them. It is possible that in the finality, your company ends up 'purchasing' the salvage of the items.... or the insurance company simply gives it away since it has little, if any, value and not worth 'selling'.

Yeah your right if that is how most company's do that but the company i work for "On Side Restoration" well we tell the homeowners that we are throwing all the items such as flat screen t.v's, stereo systems to furniture and clothing. I mean this lady house we did had 5 bedroom with 3 bathrooms and a jacuzzi in one of them, meaning she was rich and we told her we were writing off all the items in her house and throwing them away but instead we took all her stuff back to our shop and have not thrown not one of her items into the garbage i should know cause we bought one of her 3 computers for $50 and one of her 4 flat screen t.v's its a 50 flat screen Samsung HDTV for $100 for some reason you keep mentioning the insurance company keeping the stuff well like i said the insurance company has nothing ti do with any of the items we has taken from peoples houses. (In simple terms we tell the homeowners that we are throwing the items away after we have written them off from fire, smoke, flood, wet or even if we think there damaged but not but instead we take all the items back to the shop and sell them to each other when the claim has been finalized.)

So whats the problem? Homeowners get new stuff, and the restoration company does whatever it wants with the old damaged stuff. Seems like an even trade to me.

Are you asking if that is illegal, because it is not. If the stuff is sell-able, why would they throw it out? our landfills are full enough as it is.

Plus the company needs to make money somehow. :cool:

The insurance company has chosen to disregard the salvage value of the items. I'm sure if the homeowner asked the insurance company if they could keep the damaged goods, the company would probably allow it. Maybe they might see a chance to recover some of the damages paid and charge a small fee. In the mean time, your company is benefitting.
