Flu Shot

What is the name of your state (only U.S. law)? Indiana

My employer is offering half price flu shots to employee family members. I asked my ex if he could bring our daughter. He told me last month that his place of employment will have them for free.

This week I asked if she had her flu shot yet. His reply was that she is not going to receive one. She did not have one last year, and he is not getting her one this year. He has no reason.

Over the 5 years that we were together he got a flu shot every year. He never skipped a year. I am getting one, and I would like for our daughter to receive one. I am concerned that if I get it for her against his wishes he'll have me charged with contempt. I am even more concerned that our daughter will catch H1N1 or the flu. We already have H1N1 in our area.

How much trouble can I get in if I get the flu shot for our daughter against his wishes? Can I legally do anything to force him to vaccinate her? I have the beginning stages of Heart Disease, and she should be vaccinated around me. She also had a viral infection several years ago that resulted in an enlarged heart for 3 months.

I don't know for sure if a non-essential vaccination would be something that you could enforce... would it possibly help you keep healthy? Yes. Would it possibly keep your daughter from getting sick. Yes. Is it a guarantee? Nope.

Did your ex say why he was refusing? What are your court orders for medical decisions? Are you NCP, or CP? I am going out on a limb and saying that you are the NCP. But until you've clarified whether or not you, by the court order have any say in medical decision, I am going to back up and wait for your answers.

He offers no explanation other than "because" she isn't getting it. Because of what? Just "because" he said so!

He was awarded sole legal custody. Our daughter's physician has stated that she is in a group that SHOULD receive the vaccine even if there were a shortage, our daughter SHOULD receive it.

Since he has sole legal, I wouldn't get the vaccine given in your shoes. Not without a court order.

I have to add that I don't plan on having my two vaccinated. It's my understanding that the regular flu shot can actually make you more susceptible to H1N1, and I'm not keen on having my kids be given vaccines that, frankly, I feel have been rushed to market.

No reason to get snarky! Since NC is North Carolina and not Non-custodial in most cases here... :rolleyes:

I feel the same way about the H1N1 vaccination. I was told that H1N1 would have been included as part of the flu vaccine this year if they would have known that it was coming. Still I am not getting it, and my daughter wouldn't either. We were told by the insurance company's nurse that the regular flu vaccine will provide some protection against H1N1 since it is a variation of the flu virus.

I won't even try with a CO. The judge more than likely won't hear it.
