If my sister wanted to give me legal temporary custody of her child and there is no custody agreement in place right now between her and the babies father, does he have to agree to giving me custody?

Dad and all putative dads would have to be served. And then he could fight for custody of his child. Unless you can prove him LEGALLY UNFIT he would have to agree.
