Child support venue change = child custody venue change?

What is the name of your state (only U.S. law)? Texas, Williamson County

Ok, just got a notice that my ex is trying to move the venue of the child support case to her home state of Indiana.

I have have been told and have been shown.. child support and child custody are separate issues.. to the point that the judge booted our child support case to another court (the court next door), but yet that same judge would still hear arguments about the child custody.

I was given a letter today that my ex's lawyer is trying to move the child SUPPORT case to Indiana. NOTHING in this letter states anything about the current child custody case. (See scanned PDF, I have redacted some of it for privacy issues. There is a second page, but it just had the lawyers signature)

So I am just asking - before I call this lawyer up - if the child support case gets moved to Indiana, does the CUSTODY venue AUTOMATICALLY go there as well?

No, the custody venue would not automatically change, because they are two different cases. Does the child live with you or mom?

The motion is for the child support case alone. NOTHING is mentioned about the Custody case... unless that is the next volley. (As seen in the PDF File)

This support case was from a motion filed at the beginning of this year (2009).

So I am thinking about not even bothering with the support case, and setting the hearing for the custody case, just to see what happens.

Heres the time line:

December 2008: I file for reduction of Child Support.

March 2009: Hearing for Child Support Case, judge boots it over to the next court. No decision made about the Child Support.

Niether one of us make a hearing date for the SUPPORT CASE in the new Court. So I am not sure if my motion is expired or what, but the jusdge did say from the bench that all future CS cases would be in the other court, but that that HER court would still here child custody cases unles Jurisdiction was moved.

Summer comes around.

Then mid-September: I happened to be in the "neighborhood" in Indiana in September, and my youngest baby didn't want to come with me.

I understood because it was not legally my day and I wasn't going to force the issue, but there were other things tha happened that really caused me to be concerned. (I won't go into them here - but she did call teh Sheriff's DPT out, even though nothing happened. Trying to use them as a private secret service.)

Late September: I file for the motion to modify child custody ( http://micha-angel.dyndns.org/MTMCC2.pdf )

Today: I get handed a letter from a lawyer trying to move the venue for child SUPPORT.. but nothing is mentioned about custody.

So I am thinking: Ok. go ahead.. move child support. So? The two: support and custody are separate issues. You think indiana is going to be able to drain more blood out of a turnip?

But her lawyer seems to be hanging his hat on the support venue. So either he is incredibly stupid, or he just doesn't know. (Edit: her lawyrer is from Texas, the same county as the court.)

What say all of you?
