I live in Ohio. County: Hamilton

My ex and I divorced in 2006. At that time, our children were 1 and 2. We were able to amicably come to terms without a nasty divorce. We decided that it was only fair to split our time with the children 50/50 (one week on, one week off).

This worked very well until our oldest started Kindergarten this fall. It is extremely difficult to stay on top of what is going on with her school and her homework when she spends her time between us 50/50.

SO - her father and I have decided that it is in the kids' best interest if during the school year I have them the majority of the time (he will take them EOWnd and a few hours one night a week). Then, in the summer time, we will go back to our normal one week on/one week off.

My question is this: Is there a way I can file for this change myself and NOT pay for an attorney? We have all the changes laid out and agreed upon...I just feel like paying an attorney $1000 to file an amendment is a little outrageous. Has anyone had experience with this and know what I would need to do to file the change with the courts myself?

The two of you can file an agreed entry specifying the changes. That would result in nothing more than the filing fees. The court could sign off on it without even a hearing. Read your local rules (go to the Ohio Supreme Court website) regarding filing.

Why wouldn't I be able to utilize Hamilton County's court system? I have to take it as high as the Ohio Supreme Court in Columbus?

And, FYI - I can't find anything regarding the rules of filing on that website. But that may be because I'm not an attorney.

You can utilize Hamilton County's court system. I just know that the rules are on the supreme court site for Hamilton County. You can also try Hamilton County's website for the rules.

What kind of life is that for a child to be bounced back and forth like furniture? I think childern in their tender age should remain with the nurturing parent on a primary basis until the child is socially and behaviorally matured. I say this because I have a 1 year old and I've tried the back and forth thing. It isn't working. My child comes back to me with rashes all over his body, smelling like an ash tray ( I don't smoke but his dad and extended family does), sleep pattern is thrown off. Every time my child returns to me, I have to nurse him back to health, and start from scratch with getting him adjusted to bed time routines. Any response is greatly appreciated.
