My attorney filed a notice of appeal and is currently working on the appeal. At my recent contempt of court hearing, when my lawyer mentioned to the new judge that income had been imputed and my childsupport had been raised after considering my circumstances, he had a look on his face like:eek::confused:. My attorney advised my to just give them pretty much all of the money I make even though it doesnt cover the childsupport obligation. She said the worst that could happen is that I would be found in default and not contempt. That is all good and well but I have another kid to provide for also.

And ofcourse everyone has bills. By the way, as i mentioned before I have a neuromuscular disorder. Seriously, my body cannot handle manual labor. With car sales I am sitting down most of the time.
What kind of disorder?

(there's a reason for my question)

I dont think I would be considered voluntarily underemployed. I have been doing the same thing, car sales, for the past 8 years. In the past I made a very good living in this profession. The business just isnt good right now. If I have been doing this for the past 8 years how can I be seen as being underemployed????
This is an exact quote of what you posted in your other thread:

This is why the court has determined that you are underemployed.

When did you recieve your B.S. degree?
When was the last time that you worked in industrial enginering?
If you never worked in that capacity, when was the last time that you conducted a job search for that work?

You stated that you are 1 year away from having your M.B.A. that leads us to believe that you are still attending school working toward that degree.

Are you still attending school?
If not, when was the last time you attended at all?

Myasthenia gravis is a neuromuscular disorder similar to muscular schlerosis, except there is no scarring of the brain. Basically, your immune system turns against you and starts attacking your muscles with antibodies. The antibodies block the neuromuscular junction so your muscles dont receive the messages from your brain to contract and relax. Thus, they cease functioning totally are have limited mobility. It varies depending on the day. Sometimes, like the stressful day at trial, I could barely talk. It affects your breathing also. For me it is mostly my arms, legs, eyes, and speech. I have to receive plasmapheresis, similar to dialysis in that they remove all 3 liters of blood and filter it through a machine then reintroduce it into your body with fresh albumen to replace the albumen that is infected by the antibodies. I graduated in 2001 shortly after 9-11. I worked as a contracted weapons designer for 6 months and have been selling cars ever since. I was making $2800 per month as a weapons designer and about $6k per month as a car salesman. I chose car sales and have been doing this for the past 8 years.

When was the last time that you worked in industrial enginering?
The last time I worked in engineering was 2001.

You stated that you are 1 year away from having your M.B.A. that leads us to believe that you are still attending school working toward that degree.

If not, when was the last time you attended at all?


I am no longer attending school as I have to pay this enormous amount of child support or go to jail. The last time I attended school was last semester. I have a 4.0 GPA so far. None the less, I had to drop out. I think the advanced degree would have opened doors to positions that were not physically challenging and more managerial. I just cant do the whole standing up for extended periods of time, walking around to much, or be exposed to heat or too much cold. Especially heat, I will literally melt. All these things either aggrivate my disorder or my muscles fatigue too quickly to accomplish them.

It would have been a whole lot easier on everyone if you had informed us of your medical problem from the beginning of your posts.

Do you have an attorney?
if not, I really hope that you will find one, or at least get a consult with one. You really need to bring your medical problem to the court because frankly, your condition will not improve. (My own brother had myasthenia gravis, so I understand fully what you are facing and my prayers are with you.)

The reason that you need an attorney is that this really needs to be brought to the courts attention in the correct way, which will include producing your medical records and possibly testimony of your Dr. Alot of people can get this done pro-se, but since you left out this extremely important detail here, it indicates that you may not be able to properly bring this to the court's attention without the help of an attorney.

I thought he did, but I'm trying to post, get ready for work, and field phone calls from my hubby and son and daughter so I didn't have time to look up previous posts. I guess I'm just getting too old to be good at multi-tasking anymore.:eek:

I have an attorney and I submitted my medical record to the court, which was 11 inches high. And that was only from 2007 and 2008. I had 16 emergency room visits and was hospitalized 9 of the 16 times during those 2 years. I doubt the judge looked through my medical records, just as I think he didnt listen to the phone calls I recorded. That is just speculation though. When we went to court the ex tried to say that she didnt think I should get unsupervised visitation or visitation outside the state of Iowa because of the unpredictability of my health condition and shortly after stated that she thought that I was definitely healthy enough to work. So basically she wants it her way both ways. The reason I am asking for advice is because my attorney and the ex's attorney are a little too "buddy buddy" for comfort. I dont know if she really has my best interest in mind. I just want to know if she is doing everything possible to help me. She even stated that she was really close with the ex's lawyer. Is this a bad thing?

Im very happy to hear that someone knows about myasthenia gravis. When I tell most people what is wrong with me, all I get is crazy looks. Most people have never heard of it. It is definitely life changing.

Nobody can second guess your lawyer - or even comment on her relationship with the ex's lawyer. We can't guess why she is or isn't doing something - these are questions you need to be asking her.

If you don't feel comfortable you really need to hire someone else; your attorney is the only one who really knows your case and you have some complex factors that take it out of the range of "what usually happens" and throws it into such a gray area that honestly, I believe we'd be doing not only you but the forum a disservice if we were to do anything more than we really already have, you know?

I'm genuinely sorry you're going through this but I'm just not sure what else we can do to help you? :confused:
