What is the name of your state (only U.S. law)? Texas and Ohio
BACKGROUND
I am the custodial parent of 2 kids (13 and 15). I live in Ohio but the order and the non custodial are in TX. I am currently in the process of transferring the case to Ohio to make filing things and enforcement simpler on me.
He is currently 9000 behind in support and has had 38 jobs since the divorce was final in 2001. In 2005 he was 11000 behind and his wife was hurt in an accident and they paid it in full at that time to avoid him being put in jail. He has moved over 18 times, and has not filed taxes in just over 6 years (about the same time he found out that if he did file I would get the money because of the arrears). He currently has no drivers license and has a warrant out for his arrest at the moment. He has been arrested no less than 3 times for criminal non support.
He currently found what he thinks is his loophole, contract labor. He is a ranch hand who takes care of a ranch since the owner does not live there. He says his income is 18000 a year (1500 a month) and that they pay rent for living there on the property, in the smaller residence. I do not believe they are paying rent and that they are attempting to hide that form of income from me. (per the 15yr old and their history)
His support in my opinion is not a whole lot for 2 kids, 443.30 a month. What we agreed on in 2001 for support. It has become 633.30 with 40$ for health insurance, and 150$ arrears that the AG has decided he pay a month.
Every year since my oldest was 8 he has tried to keep the kids after summer visitation. This year, I let my daughter (13) stay because she said "you got the first 12 years, dont they get anything?" (actually there was a boy involved) and there was no explaining that they didnt want it then. In the 7 years before I moved out of state, we lived less than 4 hours away and they NEVER ONCE attempted to use their weekend visitation because "it wasnt worth the drive"...
She was a straight AB student and had perfect attendance, now she is failing over half her classes and has missed 5 days of school already.
No paperwork has been filed about changing custody (they decided to stop paying child support again) and I think she needs to come home. I am afraid that she will be so angry that she will not straighten up and that the problems that started there will continue here...
Should I bring her home?
