False Testimony by Spouse

During testimony on my child support my spouse testified that she spent $300 per month on groceries and denied being on foodstamps when I have a computer printout that says she was receiving foodstamps at the time. Can I subpeona a public aid worker in her county to testify she was receiving these benefits and lied to the court or is this private info?

Where did you get the computer printout?

My guess would be from a printer. Could be a Dell, HP, Compaq or just an off brand.

Does it make a difference where the printout originated?
Yup, it just might. Is it an official record of Mom's application/approval? What exactly is it? How was it obtained?

(And you forgot Lexmark. Cute little printers, they are)

If the printout was illegally obtained it sure could make a difference to whomever obtained it. I am not aware of any method where a private citizen can obtain a welfare print out. I am not saying it cannot be done, but one would think that it would have come on up these forums frequently if it could be legally done.

It appears that Mom is collecting the full amount of CS and fraudulantly collecting food stamps.

Otherwise what reason would she have to lie about it?

OP is doing nothing more than his duty to report this abuse.

Isn't such information still available under an open records law? I recall that with a right-to-know-request form listing the benefit recipients name, the agency will provide confirmation that benefits are being drawn and how much.

They certainly won't do that in at least two states I'm aware of - perhaps this is variable by state?

I obtained the computer printout while applying for some social services for my son. Their computer database said he was on Medicaid and that the mother was "active" on foodstamps and listed the months active. I was unaware that he was on Medicaid or that she received foodstamps as she did not report either on the interrogatories. I don't understand how my spouse can be allowed to lie directly under oath on an obviously critical matter and there not be a way the court or my lawyers can refute the testimony with records or testimony from a Public Aid worker. Does anyone know what HIPPA laws say on this?

With regard to Public Aid coming after me for the money, I only pay her a small amount of child support (200.00 per month) because of prior child support obligations and I have joint physical custody. So I think she might have legitimately qualified for the foodstamps even with my payments but just lied about it when they were figuring my child support.

What would HIPAA have to do with anything?
