My husband's mother passed 2 years few years back, his sister directed his mother to signed the property she owned over my husband. The property deed is under his name. Also, he was the Power of Atty for his mother.

His passed 2 years ago. He is trying to sell the property but there is an issue because his sister who directed her mother to signed over the property to my husband is also trying to sell the property. She stated that she is the Executor for the mom will.

Can she sell the property although the deed is under my husbands name? We have the copy of the deed.

Please advise.

If your post is correct and her name is NOT on the deed and your husband has not given her authority (agent), then any sale that she might make would be found to be invalid.
Also, someone cannot just CLAIM to be an executor. They must be authorized as such by the court and have a 'Letter of Testamentory' from the court.

If the house was not owned by Mom at the time of her death, any legally appointed executor for mom's estate would NOT have any control over the property.
