I currently reside in Florida but I will be relocating to LA due to getting engaged. I am not currently engaged but my girlfriend lives there now, and I am seeking employment in the area. Untill I do find work the engagement thing is on hold. First muct come the job then the move, then the engagement.

My son and my ex live in Florida. I was wondering how to handle visitations and if there is anything legally that she can do to prevent me from flying to see him and if I want have him come fly and see me.

We seem to work out visitations amicably now but I know Ill run into problems. I havent told my ex of my plan yet, I also dont know how to approach her on that as well.

I currently have him every other weekend. I will come and fly down to see him once a month thats all I probably can afford. So what kind of issues legally am I looking at?

I have been told thet legally I should be engaged before I move. I wasnt sure if legally she can say Im abandoning my son.

You are the NCP it doesn't matter why you are moving. The courts can't stop an adult from moving only the child. You should make sure before you move to go to court and file to have a long distance parenting plan in place. You should also plan on paying all of the transportation cost since you are the one moving.

There isn't necessarily a set plan. A commonplace one is every other Thanksgiving, one week at Christmas, every or every other Spring break, and a chunk of time in the summer. When distance or budget allows, a weekend once a month often falls into the mix as well.

It is either whatever the two of you can agree and stipulate to the court, or its whichever plan (yours or hers) that the judge deems the most appropriate for the particular child.

Just a quick plug - I found some good stuff on long-distance parenting plans at deltabravo.net.

Also you might check to see if your state has some kind of general example long-distance parenting plan. Not all of them do; my state (Idaho) didn't, but Arizona and Oregon did, if memory serves, and the examples were really helpful in creating mine.

You can alter it as you see fit.

If you can travel monthly to see your child, you can add that to any parenting plan that includes holidays/summers/etc. If you've been seeing the child EOW, that is reasonable.

You'd want to file a motion to modify visitation that includes whatever schedule you're trying to get.

The thought of voluntarily moving away from your child is odd to me, but that's a personal decision.

Thanks, I was thinking flying down once a month. Setting up a Webcam for him, emails, phone calls etc.

I understand how you feel, and I have been battling with the decision, its not an easy one to make cause I love my child more than anything in the world. I didnt choose to fall in love with someone out of state, believe me
