What is the name of your state (only U.S. law)? Florida
I know Florida has some messed up laws. Here is my story in a nutshell without dragging it out. We have joint custody with my ex have custodial rights. She moved out of the country(yes out of the country) about 6 months ago. She has repeatedly said she was coming back. Our child has been living with her grandparents while she has been gone. I see him about 3 times week. He went to visit her for about a month over the summer. Once again she said she was coming back with him but never did. According to the court, she is suppose to be providing him with insurance. Since she is NOT here, I have provided him with insurance.
Can I goto the courts and petition for me to have custodial rights for my child? I cant believe there is not a law stating that she has abandon him. Any advice would be helpful.
