How can I get custody of my nephew?

What is the name of your state (only U.S. law)? Virginia. My Nephew was recently taken from my Brother by the state. And I want to obtain custody of him, and I have no clue where to start. My brother say's he's getting him back and he sometimes he says a lot of things that aren't true. Please tell me what I have to do, I don't want to just sit here and wait until it's to late.

Where is Mom? Why do you believe you would get custody?

If you want kinship care placement, which is all you could do at this point, then you have to contact the caseworker and put yourself out there as a possible kinship care provider.

However, doing it with an attorney would help you get better results.

I don't think that my answer was relevant to and/or negated where mom is.

If CPS yanks a child, unless the other parent is local and not involved in the neglect/abuse case CPS is going to either be putting the child into foster care or looking for kinship care placement...at least on a temporary basis.

The other parent will normally have to jump through some hoops to get placement if they are not local. If the child can be with family pending that, its better for the child than stranger foster care.

Therefore auntie throwing her hat into the ring is likely in the child's best interest...no matter how things end up getting sorted out.
