what are my chances of 60/40?

What is the name of your state (only U.S. law)? Montana

I am going through a divorce. He always reminded me that he never wanted children and rarely took care of our daughter. When we first separated my he told me that he never wanted to see me or his daughter again.

I had moved into somehwat of a bachelor pad because I had nowhere else to go.

One night I went out and had one of my roommates whatch my duaghter and he left her home alone and destoyed some of her toys. I called the police and I ended up getting charged with child endangerment. That charge is still going though court.

Now, my husband wants to take my daughter. I am afriad because of that charge. I love my daughter more than anything.

Can he take her away form me? Is there a change I could sitll get at least 60/40 custody?
