Running from a protective order...legal?

Hello, I live in Texas. My mother is going through a divorce and is trying to get a protective order agenst her soon to be ex-husband, it is for domestic violence. He pretty much beat the crap out of her then went back on the road, he drives an 18 wheller cross country. Well because he refuses to give us an address they aren't going to be able to serve him the papers so they are saying that's it. He can just get away with it, refuse to be served and not hve to go to court? Is there any way around this? My mother can hardly sleep knowing he could come back at any minute, she is loosing the home she has lived in for over 5 years because of the divorce. There has to be some way to get a permanent protective order, he can't just run from the law.

If he shows up at her house she immediatly calls the police and they will serve him at that point. He has to be served for the protective order to be in effect. Does she know what company he works for? They can serve him at his job. The police can call his company ask when he will be checking in and be there to serve him when he does. Be proactive. Sometimes you have to. If all else fails you could hire a PI

He works as an owner operator, and since he owns his own truck there is no way for them to get ahold of him, he dosnt have to check in with anyone. Her fear is that she lives 30 minutes out of town by the time the police got to the house he could already have killed her or her son. Last time he was home, when the domestic violence occured he took the phone away from her and she had no way to call for help. She has a temporary protective order that will expire December 3rd, and her lawyer is trying to get it extended so we can find his address.

Internet background checks are fairly cheap and you can normal get a fairly recent address for anyone. Also, you may want to consider a PI as I stated above.

If she is worried for her safety and her son's take her to a domestic abuse shelter until this issue is addressed. You can do a google search. The locations are private and safe. They often offer free counceling as well. Get her away from danger until she is safe. A protective order only makes him legally responsible if he commits a crime. Do you believe he cares about this? Might he attack and not care about charges? This is not uncommon. If your answer is yes then definatly get her in a domestic violence shelter ASAP! She can live there like a home and work and everything. Believe me this is an amazing option with lots of emotional support and sometimes financial support as well. Oregon even offers relocation grants for women like her that pays for all the moving costs and the first months rent. See if your state has a simular program. I will be praying for you!!!!!:eek:

This post is a month old....I doubt the poster will be back and if so then I hope the problem would have been resolved in that time. :)

I hope you are right. The story is frightening. I just had someone I know loose a friend to domestic violence. It is a very serious issue!
