Depends. What exactly does the court order state regarding visitation AND transportation? How old are the children? Is the parent calling collect and expecting the other parent to pay for the calls? Why would letters be stopped? If a person was granted visitation rights and then went to prison, are they allowed the same visitation rights from in there...(like phone calls, letters, or visitation)?
You are wrong. A CP can be ordered to take the children to prison visits. They can be ordered to continue such contact with the NCP. What you think should not matter.I do not think a CP is going to be forced to take the kids to prison to visit and they should not be forced too. If the NCP wants a relationship with the kids, then dont commit crime and go to jail. With that said, I would say it is totally up to the CP on whyen to visit. Obviously the same visits are not going to happen plus prison has rules and depending on what sector the prisoner is in, there might be alot of restrictions on visitors anyways so it is totally unrealistic to expect regular visits. But I do think the NCP should be VERY nice to the CP and ask to the kids once in a while and I think the CP should take the kids to visits one in a while but they likely are not going to be forced too.
I agree that a CP can be ordered to take the children to prison visits. However, in 15+ years of participating on forums likes these, I have seen only 1 case that I can remember, where a judge actually made that kind of order, and possibly hundreds where a judge felt that it was not appropriate. You are wrong. If the incarceration was located within a reasonable distance from the CP .The NCP's sentence wasn't that long .The CP had transportation and the means to transport .The crime was not of a violent one .The NCP has had regular ongoing and meaningful relationships with their child(ren ). Depending on the minors age . That would all be taken into account .I agree that a CP can be ordered to take the children to prison visits. However, I will state that cost was a significant factor as well in many of those cases. Most people are not incarcerated in their own home town, and the cost of transportation/lodging for prison visits on top of receiving no child support while the parent is incarcerated, is a heavy burden to put on on the remaining parent...and most judges seem to be unwilling to put that burden on the remaining parent.
I have seen it happen. Of course I am in the court room far more than you are. It is very possible that visits can be court ordered -- based on everything that BL stated. So the poster who said they wouldn't be ordered was dead wrong. Of course the OP has not returned.I agree that a CP can be ordered to take the children to prison visits.
