Temp custody order??? (Sorry my son hit some buttons)

Sorry I just posted this but my son hit a button and it closed it... Very sorry....Pleas help..




My ex served me with papers to gain custody of my 11 year old after 8 years of having joint legal and physical custody. I went to an attorney who is also a family law judge and he said that the teomporay custody application that is attached was not approved because a box was not checked on the front. My ex swears he has full cutody and he is not going to give her to me on Sunday.
We switch off every week on Sundays and have for 8 years.


He has told my daughter that he has been sitting back watching me for 4 years (since he got remarried) and has written everything down yet all he could come up with in his declaration is 4 pages of lies. Saying I let my daughter stay with my mom all the time, (which I do, but not all the time, and have always done since the birth of my oldest daughter who is 18)

He has also stated that I dont take her to the doctor his wife does. That my husband and I go on vacation together, and I didnt go to my daughters graduation. He fails to mention that I had just gotten out of the hospital the day before.

His declaration is 90% lies and the truth is streched very thin. I wish you could read the entire thing because it realy is a work of art.

My question is does he have temp custody? And how do I get custody when someone is lying about you to the courts?

Pro tems are not judges. Not even close. They are attorneys who volunteer their time, not to give back to the community, but to further their careers and get a chance to PLAY judge for a few hours. They are not paid, they don't even come close to judges, nor, by CA rules, can they call themselves judges.

And I would think that you would realize that no one here can examine documents that we can't see. How about you call the courts on Monday and find out?

I need a few things. Including a crystal ball in order to read court orders (or supposed court orders) through the computer. Why isn't your attorney's word (the judge), who you PAY good enough? I'm guessing that he's actually SEEN the documents of which you speak.

Is the week-to-week setup court ordered? If that is the case, he can't keep the child when it's your week. If he does, you file for contempt of court. He doesn't get to change the rules without the court's approval, and without you getting a chance to challenge it.

Tell us what it says beside the boxes on this paper.

No, what I meant is exactly what I said, and I think I said it clearly. It is IMPOSSIBLE for someone on an internet message board to look at a document she has in her face to tell her whether or not this man was granted custody of the child based on a box on a paper that either was or was not checked. The OP has an attorney who has (I'm assuming) seen the paper in question (whatever it is) and given her HIS legal opinion on what has happened. However, for some reason the person who has SEEN the paper in question isn't good enough and now we're turning to people who CAN'T see the paper in question.
