I was hired about 6 months ago by a National retail chain. In my interview I was quoted a salary of 47,000. This employee is no longer with the company. Upon my first check I saw my salary as 50,600. I assumed this was because of my 20+ years in the industry. I have been payed this salary from day one. I have every paystub and recent bonus statements that say the above amount is my annual salary. Last week I was told that I was "overpaid". They immediately reduced my salary to $37,000. That is a decrease of $1000 a month. I never would have accepted a position at this lower pay rate. Is this legal?

The old line about "ass"uming is a cliche because it is true. When you got your very first check, you should have questioned the amount immediately. Of course your pay stub is going to say that was your salary, since that is what you were paid (rightly or wrongly). The bonus statements may be another matter, however, assuming you're talking about some manually (even if on a spreadsheet) prepared document where someone had to actually input your salary.

Is there an HR department you can talk to? What do they say?

Awwwwww.. Come on!!!
No one in their right mind would just assume that "Gee, that $47K offer they made to me, after reviewing all of my qualifications, information on application and resume and all of the interviews.... must have not factored in my 20+ years... and they decided to just give me $3.6K extra!!!"????
Of course that is not true. Admit it... You KNEW they made a mistake and just decided to hide it in the hopes that they wouldn't catch you!!!

Great!!! Shouldn't be hard for you to figure out how much you owe them!!

As long as the reduction is only until you have paid them the money you owe, then it is NOT a 'lower pay rate'. Look at is as repaying them for the money they loaned you.

Is this legal?
You'betcha!!

You're lucky they don't fire your sorry ass for knowingly STEALING from them.
