Court tomorrow...which form do I use???

What is the name of your state -Washington :confused:

Court is tomorrow for a child support modification. Several things were not included in the Proposed Modified Order of Child Support. I would like to have documents ready to try to have them included in the final order.

Do I use a Motion form or Petition form or something else completely to try to have these items included in the final order?? So confused, and not much time left. I'm really trying to be prepared for tomorrow, Please help with any thoughts, suggestions.....Thanks!

Did you SERIOUSLY wait until 3:30 pm the day before court before you are starting to prepare...really?

You cannot motion or petition anything TODAY to be heard tomorrow.

Actually no, I didn't. I had NO idea until last week that the Prosecuting Attorney didn't have all of the information I sent in. She sent a packet two weeks ago that I completed, included ALL of the information she needed re: income, deductions, child care...etc. Then last week I received the proposed child support paperwork and it didn't include ANY of my current income information or child care. The child care wasn't even addressed at all.

The letter that came with the packet said "Please review...if you have any questions, corrections, or something else to add or change please call my office and we will make any changes necessary. I called, and called, and called. I left messages every time indicating the information that the paperwork was lacking. I requested a call back each time and NEVER once heard from anyone. Finally, I got all of the information together and faxed it to the child support/Prosecuting Attorney's office.

I never did recieve a call back from them, however, I did recieve a letter from them on Friday that stated they "could not include the information that was faxed to them" and then it stated that if I would like to include the corrected income information and include child care then I would need to file it with the courts and serve the other party.

I sent them ALL of the information originally, including child care expenses. Child care expenses were also in our previous order. Like I said, I had no idea they did not have this information until late last week when I was talking to my ex-husband. Apparently, the Prosecuting Attorney returned his calls and told him that they did not recieve my paperwork. When he told me this it was after 5:00 pm. Wednesday evening, the court house has been closed until today, so there was nothing I could do in the meantime.

I was hoping that if I at least provided all of the information today for court, and had the correct forms filled out to include the information they left out, then possibly it could be included in the final order.

I know it may be too late to do anything about it, and I will accept that. If I would have known sooner, I of course would have done whatever was necessary right away. I at least have to try, I'm just frustrated because I completed everything and mailed it all to them the day after I recieved the initial paperwork from them. Unfortunately, I didn't mail it certified. I didn't think I needed to since they are located here in the town I live in, and I never had any issues sending them things in the past. I won't make that mistake again.

Any thoughts or suggestions as to whether things can be changed during court and have the information included??
 
What does your attorney say when asked?
Its going thru the State of WA. and the attorney is for the state, they represent our children, not me or my ex.

I understand they do not represent myself or my ex, however, I can't believe they told my ex this information but not me. Apparently, the attorney has called my ex multiple times and even helped him with a lot of his paperwork.

Another thing is, I noticed on the States website that my ex filed a Motion & Declaration To Present Oral Testimony on Wednesday. I still don't completely understant this, however, when I called him to ask about it he told me that the attorney called him and told him to file it AND send her his mileage info along with a mapquest map. Originally we lived 1.5 hours apart and then approx. two years ago he moved approx. 4.5 hours away.

It appears that this will be brought up in court and he is going to try to use it to reduce the new child support amount. I think we should calculate the mileage for the 1.5 hours away and use that as a reduction, can I ask that that the remaining distance/amount not be used since HE created that distance? It wasn't for employment, it was to move in with his now girlfriend.
