What is the name of your state (only U.S. law)? California
Have been living with my boyfriend for 2 yrs. and found out in August that he has been cheating on me and that he is homosexual. I cannot continue living like this. I told him that he needs to move out but won't due to financial reasons. We are on a month to month rental agreement in my name as the RENTER which I signed only. His name could not be put on due to bad credit when we applied for the apt. but was listed as and additional person living with me on another paper. But when it is time for me to move out per the papers that we signed he then needs to move out also. I don't feel that I should have to move to get him out. Help!What is the name of your state (only U.S. law)?

Sorry again, because he has just as much right to the apartment as you.

What you have to do, is give him a 30 day notice that you expect him to move out, and then in 31 days, file in your court for an eviction.

Since they have lived there for more then a year, she needs to give SIXTY days notice not 30. This is per CA law.

If she moves out in 30 days and he does not, she COULD end up being liable for whatever the landlord has to pay to get him out, since her name is on the lease and his is not.

She didn't take the proper steps to protect herself when moving in with someone she's not married to.

She could, but once he realizes that she is absolutely moving out and he won't be able to stay there, he may well get out himself.

Personally, that is what I would do...recognizing that I may end up paying another month's rent or so until the landlord is legally able to lock him out.

Of course, the other option would be to legally evict him herself, but that might not be a simple as it sounds, since she is a lessee herself.

He is the subtenant and she is his landlord.

I'm not just talking about an extra month's rent. I'm talking about lawyer fees and court costs to go through the legal eviction process before he can actually be evicted by the owner. Evicting him herself will likely be cheaper.
