What is the name of your state (only U.S. law)? California
In brief my situation is this, I have had to leave my house due to emotional abuse and the fear of physical abuse. I left 3 months ago. After 30 days, my sister and her husband helped me remove 80% of my belongings. 10 days later my x fiance called me and was irate and accused us of taking some money ($580) from him. This is false. He filed a police report that I obtained a copy of and in it he states that he found this out the day after our move. Call to me was 10 days later and he did not file the report for 16 days. There are other lies in the report. He has used this issue to change the locks on the house. Recently I told him that I needed to access the house to retrieve the rest of my property. He said the locks were changed and he had to be there to let me in and he was not available. I never got my things. The house is for sale. We are joint owners on the title and have owned the house for 8 years. I have been paying 100% of the mortgage for the last 21 months. He is no longer financially able to pay his share due to decline in business and he is paying mortgage on another house occupied by a family member who pays 0 rent.
How can I legally get into my house?

Did you both agree to sell the house, and both signed the listing?

Hi yes we both agreed to the listing. He signed it for a 3 month listing me for a 6 month. It is a realtor that he knows and the only one he wanted to use.
