What is the name of your state (only U.S. law)? Arkansas- I have 2 children who I have has sole custody of for 9&11 years. Never had problems-their father who I never married is trying for custody after numerous drug charges, currently in drug court and numerous domestic battery charges. I have filed a response with circuit clerk and myself drawn up a counter petition. I have no doubt of outcome of the case but wonder if I need an attorney to file the counter petition or may I do it like the response and represent myself.

You can always represent yourself in court -- as long as you know what you're doing. A pro-se litigant is held to the same standards as an attorney -- a judge is not going to cut you slack because you are pro-se.

Make sure you read and understand your local Rules of Court and such. Read everything you can find on the topic, from your state only. Read your Court's website.

Lots of us repped ourselves. You can do it, if you work hard. :)

if you feel capable to handle the petition yourself, then by all means familiarize yourself with the local rules and civil procedures.

what exactly has dad been convicted of? and when?

In reply to the what and whens of his convictions: For the past 13 years anything from possession, cultivation, traffic violations and the past 3 years it has been DWI's, Battery 3, traffic violations, possession of meth, possession of cs in an institution(jail) and he is currently having to do 2-5 years in drug court.
Thank you for any input and I will check out all resources and information that I may need.

So are you saying that he is dealing with pending drug charges right now? If so, then he has virtually no chance at changing primary custody to him. In fact, its a little ridiculous for him to even be trying. No wonder you feel so confident in the outcome.

Make sure that you gather the necessary evidence to prove his criminal history and the criminal charges he is dealing with now. The things in the last three years will be more important than the things 13 years ago.
