What is the name of your state (only U.S. law)?
I live near Buffalo, NY. My 14 year old got his fron tooth punced out and the other one injured. The one that came out was put back in, but they both need root canals and was told they could need more work which could carry on for years down the road. The parents of the other youth have offered to put it through their insurance, which is great news for me.

I need assurance in writing that all care needed for these teeth is going be to on the claim, and the claim will never close.

What kind of verbage should I be looking for so I know that it all problems associated in the future are covered? Assuming it is their homeowners insurance, does the dentist submit bills to them? or reimburse me?
Is this common, and how would it normally be structured?

You're not going to get an insurance claim that never closes. Let them call their insurance company.

You get an agreement that obligated the other parents. They will then turn in the receipt of their payment to their insurance agent.

DO NOT deal with the insurance company... just the parents.

I agree that there will be no "endless claim"


I do not agree that you should not deal with the insurane company..

I say, deal with the company only and not the parents, once the company gets the claim, they will need the cooperation of OP to pay the medical bills, and come to a settlement offer.. the parents really have nothing to add after the claim is submitted. They might not even be all that helpful.

How is there going to be a claim at all? What kind of insurance covers medical costs from intentional (illegal) acts??
Good point. They were kids fighting. There is a good chance it'll pay. The problem for the insurance company is they can't turn around and nonrenew until the ends of every 3rd year.

This is why you MUST demand a proper settlement which includes funds for the needed future care.

Put those funds aside for that purpose.

Do you have a lawyer? If no, get one.

I spoke with their insurance company, let my son tell them what happened and they will contact me regarding if "coverages are available".

Just for background.. holloween night, my son and a buddy get two eggs from others, throw them at other kids, same age, hit one who comes back for retribution, one punch thrown, tooth out, stitches etc, happened on sidewalk, sure he should have expected retaliation, but dental work for teeth that could have lasted to the grave is different.

If the claim stays open, why do I need settlement funds for future? Is it because they could refuse in the future? Should I expect to be able to get an estimate of anticipated care for the future for the dentist, it seems like it could be a wide range of care, covering front teeth FOREVER
It seems like a lawyer is a good investment, what should I expect? Or can I get away without? I'm thinking I better get one

Different then what.. and teeth DO NOT last "till grave"

The claim is NOT going to stay open, they will offer a settlement if anything, and you have to use that to do whatever to his teeth.

After they settle with you, it will be closed and you will be refused if you call back for more money.

These people are not responsible for your sons teeth FOREVER. Sons tooth is put back in, and there, done, problem solved. (maybe some additional monies for possible discoloration of the tooth, but thats it.)
