Ohiogal beat me to my question: Who was the owner of the car? Who was in possession of the keys?
You have an interesting argument for reasonable doubt, and it just might fly if everyone sticks to their stories. But, if it is your car, you will likely STILL be stuck with the restitution for medical bills even if they cannot charge you for the DUI. After al, if it is your car, and you were all so wasted you cannot remember who was driving, then you acted in a reckless and negligent manner letting someone else drive.
