Mailing marijuana across state lines.

What is the name of your state (only U.S. law)? Indiana

Alright, one of my buddies is getting marijuana mailed to him through USPS ( 1/4 lb ) from Cali to Indiana. He keeps telling me that since it's mailed he can't really get in trouble unless they make him "sign" for the package to seal the deal. The thing that is on his side is he's really not a "drug dealer" per se. He just picks it up and gives it all to a guy ( so police wouldn't be scoping his house for people in and out all the time and such ).

So my question is... can he only get busted if he signs for it?

( them asking would give the indication that they know and he would decline to sign, then saying he never ordered anything )

His miracle method would obviously not cover him for possession, distribution, or conspiracy.

Yeah, my point was he isn't breaking it down and selling it. Meaning he only has to worry about picking it up and driving with it. He's not going to be dealing with a lot of "customers"

He doesn't have to "break it down" or "sell it". Just playing delivery boy is enough to get charged with distribution.

The cops don't even need to see him sign for it. If you were in PG county, as soon as it was delivered at his house and he picked up the box, they'd storm the house, hold him at gunpoint and shoot his dogs.

BTW Cali provides the US with about 1/3 of all it's marijuana. sending it through the mail is not an unusual thing to do. Happens all the time

All it takes is probable cause and that's plenty of probable. Then they'll decide whether he had an active role in having it sent there.

In property law, acceptance of a gift is assumed if it is beneficial to the donee. Since it's unlikely that the donee would want the anthrax, it never becomes the receivers property.

If the receiver would want the weed, it is presumed to become his/her property.

I would say that jail is full of people whom used the same rationale as your friend. The police are very aware of thre distribution network through the U.S. mail system. It's time to stop. Greed will get you caught.Also the basic definition of "drug dealer" is one person who sells drugs to another. I am not giving an opinion or speach, but obviously he is a dealer. If you don't believe me than just keep doing what you are doing and see what the criminal charges are. Ialso think it depends on the specifics of the situation. But, I cannot see the police just letting him walk away. Anythings possible. goodluck.

I think using the federal mail system will get you in a hell of alot more trouble than just personally delivering it.

Well....your friend is "distributing" the marijuana to somebody, isn't he? Thus, he is in possession with intent to distribute--which is a felony in most states, at least.

The "probable cause" would come into play if someone working for the USPS noticed that distinctive smell, or has seen these sorts of packages before, and chooses to report it. Or if all packages, including the one with the pot in it, go through a machine similar to that which is found in airports, and the contents of the package is revealed that way.

What's so great about marijuana, anyway? It gets people in so much trouble.
