Establishing parenting plan Q & concerns

What is the name of your state (only U.S. law)? Florida
Father and I never married; father got expidited to PA when I has a few months prego and didn't see him again till cs caught up to him when child was 4 years old almost 5. No visitation order was set in place but he visited father everyother weekend; with agreement that father would not drink while our child was there. All was going well up to 2004 his wife was even baby sitting my 2 other children. In March of 2004 his father and stepmother had a falling out while our son was there and one of my other children resulting in violence. From that day I told the father that our son will not be allowed at his house and nor was his wife babysitting my children any more. I told father he was more than welcome to see his son at my house that the door was always open and he stated he didn't need me baby sitting him. In 2008 of June I took him back to cs court for modification of health insurance and high out of pocket expenses for son not covered by insurance. Cs awarded me insurance increase but said I would have to go through another agency for the medical. From 2004 to 2008 father seen son once and from 2008 to now father has seen him 3 times. Father finally filled to establish paternity and parenting plan in October with Lake County where I reside and my CS case is in Orange and they will not transfer my case to Lake County. I'm glad the father is taking action now but I have a few concerns and qustions.
1. Son is still affraid of father but does want to see him more; will he be able to speak at the hearing ( he is 12 and will be 13 in January)
2. They are now living 2 hours away and that worries me with him being that far away; can I request visitation be established to this county?
3. Can I counter petition for modification of child support and put in a motion to deviate sons med cost out of pocket $207 a month, MRI every 6 months co pay is $425, his seven doctors $50 co pay each every three months and just paid $3900 for braces that he gets on 10-23.

request a GAL or a minor's attorney

2. They are now living 2 hours away and that worries me with him being that far away; can I request visitation be established to this county?
well, that depends. was the domestic disturbance reported to police? CPS involvement?

3. Can I counter petition for modification of child support and put in a motion to deviate sons med cost out of pocket $207 a month, MRI every 6 months co pay is $425, his seven doctors $50 co pay each every three months and just paid $3900 for braces that he gets on 10-23.
i'd request a 50/50 share on medical necessary costs not covered by insurance. however, i'm a little wary of that advice since you stated the state is the one handling the child support matter.

yes it was reported to police and children and families. Child Support Enforcement holds my case but they said I could go through Clerk Of Courts to do a modification if it is less than 3 years from the last one. But the problem I am having is cs case is in Orange and he filled Establishing Paternity in Lake County where I reside so I'm not sure if I would be able to counter on the petition for modification and file motion to deviate.

So should I file for modification and put in motion to deviate because of medical in Orange with the Clerk of Courts or counter petition in Lake asking for 50 of medical costs not covered by insurance on the Establishing Paternity and Parenting Plan?

Violating agreement already

went to mediation on 12-15 agreed to shared parental responsibility and provision neither party shall consume alchol of any kind 8 prior to having child and during any visitation. Father got son 2nd half of christmas picking him up at 2pm on Christmas day; get a call from son today at 3:39 pm upset father is drinking had son put father on the phone and father told me to come get your f***ing son. Drove 2 hours to Homosassa to get son and son was crying telling me the whole time father was screaming at him, cursing at him and throwing things around. What do I do?:eek:

Son is in bed. This was sons 5th day into visitation per mediation agreement and this Friday is his weekend. And the only reson why agreed to the Parenting Plan was he was not suppose to drink. No I'm not going to with hold him from his dad; do I need to file a motion for civil contempt?
