What is the name of your state (only U.S. law)?
I live in McKinney Texas I am fifteen and I want to get emancipated for the fact that I cannot stand living with my mom anymore she is so controlling. I just want to get out. How would I start this process?

Step 1, wait until your 18th birthday - then you can ignore your mean old mama all you want.

There is not a judge in any jurisdiction that will emancipate you because your mother controls you too much.

You haven't mentioned you job, your place to stay... nothing that would make this happen... even if 15 was even considered an appropriate age.

Oh, and if the control is about a boy that you want to date and can't, don't even waste our time.

Silly person.

Don't you know that every single kid's situation somehow makes the law not apply to them?

Therefore, they have to ASK us if THEIR parents are such doo doo heads that THEY will not only be granted emancipation but will also be given a house, car and job of their choosing.

Oh, and judge will make their mean parents do pushups until they puke for being mean.

The way to start this process is to wait a minimum of two years.

A 15 year old cannot be emancipated in Texas. Period. Ever. No matter what. No matter what, but-what-ifs you can think of, the answer is NO. There are no circumstances WHATSOEVER where a 15 year old can be emancipated, in your or 47 other states. No, you cannot move to one of the two remaining states and get emancipated there; the laws of your own state are what apply.

A 16 year old, in Texas, can ONLY be emancipated if they are ALREADY living outside the home, and you cannot move out without your parents' permission. So unless your parents are willing to allow you to move out ON YOUR OWN, which does NOT mean living with your best friend or your boyfriend or even your grandmother, you cannot be emancipated at 16 either.

At the age of 17, IF you can prove to the satisfaction of a judge that you have sufficient maturity AND sufficient financial means to support yourself entirely on your own (which means that you, and only you, (not your boyfriend or your best girlfriend or your grandmother or a neighbor or anyone else paying part of it) are paying for your rent, food, clothing, utilities, medical care, insurance, transportation, school fees and supplies, and all the other incidentals of life, AND that emancipation would be in your best interest (and you will need much more than, I don't get along with my mother, for that - NO teenager gets along with his or her mother) then MAYBE you can be emancipated. Then. If the judge is in a good mood.

But not now. Emancipation is not and never was intended to be a means for a minor to leave home. It was and is intended to be a means of legal protection for those teens who, through no fault of their own, found themselves living alone.

Sigh..I always forget that every kid is special and unique. Just like all their friends ;)

So if you were a teenage rock star or an Olympic athlete, worth millions and your parents were exploiting you, you'd still have to wait until you were over 16 to be emancipated? Oh well. Pretty cruel. If we didn't have People magazine, I doubt we'd even ever have heard of "emancipation" for teens.

The state of California, which is where we will find most of the teen age rock stars (if not the Olympic athletes) will CONSIDER emancipation for teens as young as 14. It's not a guarantee, though; there are other legal options for such teens as may be experiencing parental exploitation that do not involve emancipation.

You think your mom controls you too much? Most likely as in you're fifteen and reallllllllllllly want to date that 19 year old that swears he likes you more than any girl ever - right?
Well try having two parents that each get two checks a month with close to 3 grand on them, them buying you old moldy bread and milk because its cheaper, you wearing the same clothes for the past 2 years, and getting physically and mentally abused every single night cause dad drank an 18 pack and moms downed more than a fifth of whiskey.
Cause that is what I go through...and not even I can get emancipated.

But YOU could go to CPS and get placed in foster care if necessary. There are avenues of help for abused/neglected minors. For those who are merely being annoyed by their parents....they just have to suck it up like every other teenager.

There is only a few months before I am 18. I am getting ready to move with a friend and get a job at her uncles company. As soon as I get some money I am going to get health/dental insurance [cause I havent been to the dentist in the last five years]. It is too ridiculous to get DHS involved because if I did they wouldn't believe me cause my parents fake happiness so well [being my mom is teacher and my dad is a salesman]. there wouldnt be a way to prove that im verbally abused and i do not bruise unless i get hit really hard so there is not physical evidence.
