My brother is going to get a divorce with his wife (I'm an uncle, asking for him). They have a kid. She is currently living with the mother. My brother lives in the house with my parents and I.

My brother wants to take the kid full-time now but the divorce has not been completed or filed yet, can he legally do that?

So his daughter is living with mom and your brother just wants to take her full time? Why? Legally he has equal rights to his child but quite frankly why would that be in the best interest of the child? Does he not want to pay child support to mom? What is his reaosning for taking the child?

Who had been the primary caregiver? Had they shared caregiving? How far away from the family home did each of them move? Can either keep the child in the same school with their same friends where they now live?
