oregon:confused: ok we went to court the judge took thirty days to come to her decision she wanted to check the statue of limitations and all ,, she notified us in writeing of her decision ,,I won !!! Now can she (the defendant )still file a counter claim???:confused:What is the name of your state( i am in Oregon)?ok well this all began a fe years ago when i was in a car wreck that took my daughters life,the lady is christine jackson she was my employer at the time of the accident well all said i was in hospitals and rehabilitation for along time,my sister was the head manajor of the kitchen where we worked in a restraunt,so i kept contact with now my exboss chris well in the process of me getting better she new i was getting a seattlement from the accident and was able at that time to let me have her car a pathfinder and a trailor on the agreement that as soon as my settlement came in i was to pay her in full and which i did ,the amount that i paid her i was unsure of the total amount cause she kept saying different prices but i wanted to make sure so i over paid her about eight thousand i was only able to prove 4.800. of it it took me awhile to take her to court but i was in the statue,so i finally got the courage up and did thats where i am now i won my case but can she still file a counter claim not that she has any reason what so ever to do so.what is that statue on a counter claim orcrude i forgot the name they called it but where she can take me

Not enough info.

Had the SOL actually expired? What exactly is the counter-claim about? What was the original case about?

The time to file a counter-claim was when the case had yet to be decided. Since the hearing has already taken place and verdict decided, there can be no counter-claim by the other side. They can, however, file to appeal the judge's decision against them if there is a legal basis to do so.

She can file a claim against you for whatever damages she may have. It may not be a counterclaim but it would be a claim.
