Ebay Purchase Gone Bad

My husband purchased an IPHONE from a person in WV. He rcvd that phone and there were several features that did not work, especially the physical vibrate feature. The phone was listed as works great or something to that effect. It had an after market case put on and my husband believes the seller broke the phone, in many place, internally. The listing stated AS IS and when the seller was contacted by husband 1 day after rcvning the phone - he was told it's as is, if he wants other action, contact Ebay and file a complaint. My husband did this and followed up with EBAY also, and won the dispute. He sent the phone back and rcvd a full refund. The seller, since, has emailed threats and made at least one known threatening phone call, threatening to sue or take legal action-his brother is a cop, etc, calling my husband a theif. Since then, my husband took ANOTHER chance and pretty much was defrauded on EBAY, again, they sided with him. Needless to say, we are done with EBAY, period...but what I want to know is can this man take action against my husband? Does the law protect him or side with the seller? I am incredibly anxious to know what we can do to protect ourselves or just to find out 'can he sue?' Please help.We are in Texas. The phone was $300.

The guy has his phone back and you have your money back. What is he going to sue for? He has no damages. To attempt to sue you from 1,000 miles away over $300 would be idiotic. Just ignore him.

What exactly does it say? Did your husband know there was an after-market case?

Either way, nothing can be done. You are both whole.

If you used a credit card for your transaction, even with paypal, file a dispute with your credit card company. I never buy any electronics, on ebay, with out using paypal and a credit card. If it's bad/defective, I have two layers of protection. If paypal fails, I issue a chargeback.

Did you miss the part where her husband got a refund? He can't get more than that back.

OP is just wanting to know (on this should be dead thread) if the seller from the first transaction can come after her husband legally. And her question has been answered. The part I've quoted is extraneous details posted by the OP that doesn't factor into the OP's question. So, you get a massive FAIL. You'll not ever pass a MS cert exam. :rolleyes::rolleyes:
