My ex girlfriend signed over sole legal and physical custody of our now 11 month old daughter to me about 7 months ago. She has dual citizenship in another country and was threatening to leave the country with the baby, so I filed a Petition for Custody to stop her from leaving the state. Then she agreed to give up full custody to me, as long as she would be able to leave the country herself.

Since then our relationship has deteriorated even more despite my efforts to work it out, she just wants to do her own thing, she left me and I have found out through mutual friends she has been making plans to try to take my daughter, possibly out of the country, so I stopped letting her see the baby unsupervised. I still allow her to see the baby almost daily though as long as I'm there.

Now she wants to go to court to get full custody herself, and I am afraid she might be able to. Right now she works full time from 10 am to 8 pm, and has no furniture in her apartment, and I provide the car for her to drive. If she has the baby, she has no one to take care of her while she's at work.

I work from home and take care of my daughter all day, and my mother also takes care of her. I do not want my ex gf to get any custody and take my daughter to a third world country. She has no support here, her whole family is in another country and she wants to go back with my daughter. I dont think she has my daughters best interests in mind, and she doesn't care how she affects anyone else, she just wants to get her way.

What could she do to get custody back? (She signed and notarized a Stipulation and Order for Custody, granting me sole physical and legal custody, and it was signed by the judge. We never went before a judge though) What can i do to prevent her from getting custody back or to prepare for this?

Also, since I have full custody right now, should I try to get child support from her? Will that help or hurt me? (This is in California.) Thank youWhat is the name of your state (only U.S. law)?

Yea you should go after her for child support, and bring the whole matter before a judge regarding the visitation. get a plan.

You stated that you were only allowing mom supervised visitation with the child. Do your court orders allow you to do that? What do they say about mom's visitation?

The reason why I ask is that if mom has a visitation schedule, and you are not honoring that schedule, then you are giving mom the necessary ammo/change in circumstance to take you back to court to reverse custody.

I agree. I still want an answer to my question though. Because if he and mom lived together over the last seven months ......

Also, what citizenship does mom hold?

Have you lived with her since seven months ago when you got sole custody?
No, I haven't lived with her, even though I was providing her with the apartment she was staying in for my daughter's sake, we were not getting along and I was not staying with her. Now she has moved out of there and got her own place. How does that affect me?

Actually the court orders say no visitation rights. I was still allowing her to see my daughter because I felt bad and still wanted my daughter to have a relationship with her mother, but now she is back to wanting to leave the country with her, and I need to know what she can do and how I can be prepared. Thanks.

She has dual American and Mexican citizenship. Does it go against me that I was paying for her apartment after she gave me sole custody, even though we didnt live together? thanks
