What is the name of your state (only U.S. law)? California

Does anyone know what the penalty is if any for putting your name on a childs birth certificate that isn't your biological child. My baby's mama had her boyfriend put on my daughters BC. She says for insurance purposes.

No penalty. You need to file in court to establish yourself as the father (through a court ordered dna test) and get the BC amended.

Thanks for the reply. Does it have to be through the court if all 3 of agree. She didn't get a DNA test to put him on the BC.

The court won't allow the birth certificate to be changed without proof of paternity - a court-ordered DNA test, or an affidavit of paternity.

Just being on the BC does not make him the legal father or give him any rights. The court has to order custody/visitation/support orders before any father has any legal rights, when the parents are not married. If you want rights, all you have to do is ask for them and prove the child is yours.
