What is the name of your state (only U.S. law)? OH

This is what it says in the newspaper about my son's father......


Dad's Name, 31, of 555 Sesame St., Apt. *, Town, was charged with fifth-degree felony non-support of dependents. Dad is accused of failing to pay more than $12,000 in support between 1997 and 2009.

He actually owes me over $14,400. I was just wondering what he is likely to get out of a charge like that. (if he even shows up for court)

He could actually get a jail sentence out of that one. They are charging him with an actual crime.

Depending on the county, many of the prosecutors -- including in the various counties I practice -- do NOT play around with non support at this level. The court most likely will put out a warrant if he doesn't show and if he does show and it is proven, he is going to jail. He will not pass go, he will not collect anything but pretty little bracelets. It will not be taken lightly.

I know which judge it is, but only the municipal court docket is posted online as far as I can tell and the letter I got said he was going to common pleas court. I'm not sure if I'm allowed access to that info, and if I am, would call Child Support, or the court house, or what.

Call the court house. That information is PUBLIC information.

Give me a minute and I may be able to find out.... I found him and can tell you he is NOT in prison in Ohio. Nor is he in the county jail.

My son's step mom just sent me a message and said that dad is going to court next week and that they want to put him in prison. She said they want me to sign some paper that says he no longer owes it to me. There is no way in **** that I am going to, but I was curious as to if it is even legal. My son is on medicaid, and the state went after dad for child support. It would make my/my son's life easier if I could just honestly say to them that I legally can't do it.

Yes you could forgive his arrears. That is legal. BUT DO NOT DO SO. Let him suffer. DO NOT SIGN IT AT ALL.

I can't imagine that crossing anyone's mind! 10 years with no support and his girlfriend wants you to sign papers?
I'd show up and sign "when pigs fly" on the dotted line. or perhaps "don't drop the soap dirtbag"
 
I'm not signing. My son deserves this money. He is getting an F in band right now because I cannot afford his Tuba. It would be nice to have some financial help since I don't get any other help. I hope if they are going to put him in jail that they have some kind of work release program or something or I still won't be getting anything. :(

My aunt said that my cousin was able to sign away only some of the back support, just enough to keep her X out of prison....Can that really happen? I don't want to send my X to prison. He's kinda sucked as a dad, but can you imagine how my son would feel knowing I could keep his dad out of prison and didn't? He is offering to pay me in cash, a portion of what he owes me and give me a vehicle (worth about 1,400). If I can just sign away enough to keep him out of prison, get the 3000 and the vehicle, then he'll still owe me the rest, I want to do that.

And what are you teaching your son about breaking the law and being punished for doing so? Your ex did this BY CHOICE... he should be held responsible.

Yeah, I get that, but how exactly is dad going to pay child support from prison? My van is broken down, so I need the blazer too, and rent is due so I really need the money right now.

Clearly he isn't paying, and somehow you think that is going to change because your nice to him once?

He had plenty of chances to pay before it reached this lvl of trouble and he didn't.. he just wants you to let him off.

The only thing that will come from this if you do this is him expecting you to "bail" him out again next time... cause when someone lets it get this bad, there will be a next time.

I totaly get what you are saying, and I'm sure you're probably right, but if he goes to prison I get nothing. If I make this deal, I get 3,000 and a blazer. I don't think he'll start paying because I'm nice to him. I'm really not that naive. I think he'll start paying because they finally know where he lives and his girlfriend/mother of his other child is on public assistance so they will know where they live. That is how they(child support) finally found him in the first place.
